As we watched this firestorm unfold, certain facts have been forgotten. First this came to the forefront when it was made known when Congress voted against a ban on U.S. military funding of ‘sex change’ surgeries. The House of Representatives voted 209 to 214 to defeat the amendment denying the Pentagon funds for “sex change” surgeries.
The amendment “would make it so ‘funds available to the Department of Defense may not be used to provide medical treatment (other than mental health treatment) related to gender transition to a person entitled to medical care,’” The Hill .
My conservative viewpoint is that taxpayers should not be on the hook for any or all costs related to transgender sex change surgeries or mental health while they serve in the military. These people should have considered their position and found the money prior to enlisting for this kind of thing including any mental health evaluations or considerations for medical treatments before or after surgery nor all the pain and suffering they would go through. If flat feet; certain other physical disabilities like eyes, weight, height, or mental stability or age are strong considerations that prevent enlistment–then the same consideration should be made in the case of those who “believe” they are locked in the wrong body and want to disfigure that body to correct to their “beliefs.”
This is about a very narrow band of military personnel – UNLESS the whole LGBTQ community are now once again narrowing the wording they have been floating around for the last year to only be Transgender. If so then all those ridiculous nomenclatures that have been floating out and around should be erased from every nook and crannie including LGBTQ while the only word that remains becomes TRANSGENDER. It is after all very hard to keep up with the fast flutterings of all things gender related any more. As I see the quote below and from the little I know of Trumps tweets, he says what he means not what someone else wants to read into it. In that case, how many fit under the Transgender list? Lesbians, Gays, and others aren’t transgenders (at least I don’t think so but then to me its all Martian).
Trump tweets: “After consultation with my Generals and military experts, please be advised that the United States Government will not accept or allow…..
….Transgender individuals to serve in any capacity in the U.S. Military. Our military must be focused on decisive and overwhelming…..
A second consideration just as powerful is that Obama was a weasel. He had the Department of Defense make all the decisions and issue their change in internal policy. He never made the time to send an act through congress to issue this same consideration from 2009 through 2016 especially in the first few years when the Democrats dominated congress.
Plainly he didn’t want this on his record or to have to deal with the firestorm. A change in policy by someone in the DoD does NOT carry the same weight in such an instance as when we are discussing changes that solidify our amendment rights on specific issues. Nor would a ruling by the Supreme Court as far as I am concerned because it must first be bound in our laws under the constitution.
This is exactly why having the Supreme Court MAKE a law on what constitutes a marriage should NEVER have occurred. First some of the judges should have recused themselves and second it is not their right to pluck out of thin air a LAW that affects not JUST marriage but has extremely far-reaching and problematic consequences as we have seen.
But an even more problematic and destructive assault on our constitution and the laws of our country can be found below in an excerpt from the letter sent by Democrats to the Department of Defense Secretary as in my eyes at least it is a “THREAT to civil order and obedience of rule of law.” They should be brought before congress, removed from office by the states they represent, and made to appear in court to answer for charges of anarchy.
They seemed to have forgotten an important issue here and one that should NOT be taken lightly–the President of the United States is commander-in-chief of the military forces — NOT individuals who are holding court in the media nor think to sway congress or any government agency to break with federal law or to take a communist/socialist stance.
August 4, 2017 Letter sent to Defense Secretary Mattis and General Dunford
“As Members of Congress with an abiding interest in our nation’s military and its policies toward the LGBTQ community, we write not only to express our strong opposition to President Trump’s recent tweets seeking to ban transgender individuals from the military, but to remind you not to comply with any unconstitutional directive which may ultimately be issued.“
The letter was signed by the following people:
John Conyers, Jr ; Adam Smith ; Jerrold Nadler; David Cicilline; Jim Cooper; Zoe Lofgren; Barbara Lee; Robert Brady; Susan Davis; James Langevin; Rick Larsen; Steve Cohen; Joe Courtney; Hank Johnson, Jr; Niki Tsongas; Jackie Speier; John Garamendi; Jared Polis; Ted Deutsch; Karen Bass; Cedric Richmond; Colleen Hanabusa; Carol Shea-Porter; Hakeem Jeffries; Joseph P. Kennedy III; Beto O’Rourke; Mark Pocan; Eric Swalwell; Mark Takano; Marc Veasey; Donald Norcross; Ruben Gallego; Ted Lieu; Seth Moulton; Bradley Schneider; Anthony Brown; Salud Carbajal; Pramila Jarapal; Ro Khanna; Donald McEachin; Stephanie Murphy; Tom O’Halleran; Jimmy Panetta; Jamie Raskin; Jackie Rosen; Thomas Suozzi; Madeline Bordallo; Dan Kildee; and Linda Sanchez
These then folks are the new Democrat upcoming regime. I notice many of the usual suspects are missing from this list. Is it they decided for once to let the younger ones take the heat and test the waters? OR, have the younger members decided to cast out upon the waters so to speak on their own?
Either way, have these members actually studied the constitution, served in the military, or know what treason and anarchy produce in real life countries? Just because some or most have legal backgrounds does not mean they are familiar enough with the constitution and its powers for the three branches nor have they witnessed first hand for more than the length of a movie or a day what real chaos and socialism is like. (There are two that can claim that–one having worked in the Peace Corp and one himself a first generation immigrant from Mexico.)
Of all that I randomly pulled to scan (about 1 in 4) not one was noted by Wikileaks to have served in the military. A few came up the hard way, but many came up from privileged backgrounds. Only a small percentage were listed as first, second, or third generation immigrants. They I would have thought would have known better than to blindly accept a socialist platform but I guess not.
So my question to them—-have you individually talked one-on-one with random members of the military currently serving in war zones and veterans who came home from war zones in a NON-threatening setting about any concerns or problems they experienced both as straight and gay members during combat before you signed your name to a high-profile letter that could actually be in and of itself considered ILLEGAL AND TREASONOUS? They in point of fact are the ONLY one that this matters to on a daily basis. OR like all other Democrats have you decided like zombies to follow a written script without questioning why you put your signature to documents or vote yes or no as a block ticket?
If not I would label you “S&*#@S” and fake US citizens for having either signed or written the above letter.
Looking at the issue:
Newsweek – Is it legal? If Trump bans transgender military members, It might not stand up in court
By Aidan Quigley 7/26/17
Leading civil rights and LGBT organizations have a simple message for President Donald Trump: Move forward with your plan to bar transgender soldiers from the military, and we’ll see you in court.
Lambda Legal, a leading LGBT legal organization, will file suit “immediately” if Trump’s tweets turn into policy, and the American Civil Liberties Union also is ready to take legal action if the current policy changes.
Block believes it would violate the Constitution’s equal protection clause and the Administrative Procedure Act. The APA protects individuals from “arbitrary or capricious” actions.
San Francisco Chronicle, By Bob Egelko, “Military transgender ban would be tough to overturn, experts say.”July 26, 2017
Eugene Fidell, a longtime attorney and commentator on military law who teaches courses in the subject at Yale Law School. “The government has very broad discretion in this area, and federal courts are extraordinarily deferential to governmental decision-making on military policy,” Fidell said. While he considers Trump’s policy “misguided,” he said it would be “hard litigation to try to overturn this.”
Transgender men and women have been serving openly in the military since June 2016, when President Barack Obama’s administration ordered a halt to their expulsion. Liberal quotes list the possible number of LGBTQ between 2,000 and 15,000 depending on the sites.
Timeline and Facts:
Executive Order 10450 – issued April 27, 1953 by President Eisenhower – Previously, the criteria used to define a security risk were largely political, that is, affiliation with suspect organizations or a clear demonstration of disloyalty. Executive Order 10450 added more general estimations of character, stability, and reliability. Its language was broad: “Any criminal, infamous, dishonest, immoral, or notoriously disgraceful conduct, habitual use of intoxicants to excess, drug addiction, or sexual perversion.” At the same time, the executive order’s provisions contained advice on evaluating character problems, as in its provision that the medical valuation of a psychological problem should show “due regard to the transient or continuing effect of the illness.
“Don’t ask, don’t tell” (DADT) was the official United States policy on military service by gays, bisexuals, and lesbians, instituted by the Clinton Administration on February 28, 1994, when Department of Defense Directive 1304.26 issued on December 21, 1993, took effect. This relaxation of legal restrictions on service by gays and lesbians in the armed forces was mandated by United States federal law Pub.L. 103–160 (10 U.S.C. § 654), which was signed November 30, 1993.
Executive Order 13598—Assignment of Functions Relating to Certain Promotion and Appointment Actions in the Armed Forces. Regardless of ANY change in assignment of functions NO executive branch department nor secretary has the same power of law as those issued by the President. In any case all executive orders memorandums, or any other written form used by a president are subject to judicial review and can be challenged though they do carry the weight of law.
Politico June 2015 – “White House press secretary Josh Earnest called Carter’s comments “welcome,” adding that Obama “agrees with the sentiment that all Americans who are qualified to serve should be able to serve.” But Earnest said policy changes would be up to the Defense Department – a line he repeated when asked about the matter on Tuesday. A Pentagon spokesman says there’s no “specific review” of the military’s transgender policy. But a “routine, periodic review” of policies related to medical standards for military service began in February and is likely to take a year or 18 months. The last such update took place in 2011.”
In 2015 NBC wrote just weeks after the SCOTUS decision which MADE a law concerning marriage, “Defense Secretary Ash Carter announced that the services have six months to figure out the logistics of integrating transgender troops into the military.”
“Statement by Secretary of Defense Ash Carter on DOD Transgender Policy”Release No: NR-272-15 July 13, 2015 by Secretary Carter. “The Defense Department’s current regulations regarding transgender service members are outdated and are causing uncertainty that distracts commanders from our core missions. Today, I am issuing two directives to deal with this matter. 1) study over the next six months the policy and readiness implications of welcoming transgender persons to serve openly, and 2) directing that decision authority in all administrative discharges for those diagnosed with gender dysphoria or who identify themselves as transgender be elevated to Under Secretary Carson, who will make determinations on all potential separations.
“Department of Defense Press Briefing by Secretary Carter on Transgender Service Policies in the Pentagon Briefing Room” Secretary of Defense Ash Carter June 30, 2016 introduced directly from Carter the reasoning.
DoD 2016 Transgender Policy issued.
