Napolitano: ‘Reprehensible,’ ‘Lawless’ Stockpiling of Gun Owner Info

Judge Andrew Napolitano appeared on “Fox and Friends” this morning to react to a bombshell report that the the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) is illegally stockpiling the personal information of gun owners.

Judge Napolitano explained that the government is supposed to gather that information for statistical purposes only, and they are mandated to destroy identifiable information such as names and addresses.

The report from the U.S. Government Accountability Office (GAO), however, found that the ATF is not adhering to that policy.

“Congress decided that since the states regulate guns – not the federal government – the federal government would never be able to keep a list of every gun owner and every gun owned by that person,” Judge Napolitano said. “But they are.”

He attributed this disturbing revelation to the anti-gun policies of the Obama administration: “This lawless administration has broken that law and retained that information.”

He warned that this is not only illegal, it gives a future anti-gun president or administration the ability to harass gun owners and possibly even confiscate their firearms.

“It’s reprehensible, it violates federal law, it violates a Supreme Court opinion, it violates our natural right to self-defense, which is protected by the Second Amendment.”

    Damnation Obama and Hildabeast are bent on getting rid of guns in responsible citizens.

    They must do it to make sure no one revolts once Hillary takes office to install a complete Commie government. Dear God, don’t let her win.

    Here in KY we have no registration so nobody knows who has guns.

      Count yourself lucky Pepper But I am willing to bet heavily every seller has had by federal law provided lists of at least the ones buying more than one gun.

      I hate to tell you Pepp, these are BATF records. Anyone purchasing a firearm must go through the NICS system. Its these records that are being kept.

        Nox here is the exemption we have in KY.

        Purchases of firearms which are subject to the National Firearms Act (i.e. machine guns, destructive devices, etc.) and that have been approved for transfer under 27 CFR Part 179 are not subject to a NICS check.

        Purchases of firearms, in which the Secretary of the Treasury determines compliance with NICS to be impractical because of the ratio of law enforcement officers to land area of the state (less than 25 officers per 10,000 square miles) along with the absence of telecommunications facilities, are also exempt.

            HN, I don’t know since I didn’t move here until 2007. Probably was though. Things are pretty wide open here. You can even buy a machine gun if you want.

            Even with a dem as governor for 3 terms until Bevin was voted in won’t touch guns. They know if they do they are DONE!

    What hasn’t been mentioned? When Obama began his war on all of the guns, something happened.

    It was as if he was INVITING people to buy guns; and they did.

    Not only that, OBAMA BOUGHT STOCK in gun-maker corporations.
