Obama Has No Authority to Lift Embargo on Cuba

Cuba’s release of American hostage Alan Gross is to be welcome. Gross has vegetated in a Cuban jail for five years for the crime of bringing computers to Jews on the island.

But exchanging three hardened Cuban spies for him establishes a wrong moral and legal equivalency. Worse, extending recognition to Cuba’s dictatorial regime harms U.S. national interests and fails to advance freedom in Cuba.

The White House “Fact Sheet” on Cuba makes clear that the Obama administration received nothing in exchange for its many and substantial concessions to Havana’s Communist regime. In essence, after five years of “negotiations,” the White House ended up where Raul Castro started: Gross would be exchanged for three Cuban spies whose activities led to the death of an American in the 1990s.

The administration’s announcement that “the president has instructed the secretary of state to immediately initiate discussions with Cuba on the re-establishment of diplomatic relations with Cuba,” also gives in to a longstanding Castro demand. Cubans will not gain freedom of expression, of association, of thought or of anything else as a result.

Moreover, the White House’s explanation that it was acting because “U.S. policy towards Cuba has isolated the United States from regional and international partners,” shows degrees of fecklessness that should put fear into Israel and other allies for which American support brings condemnation of the U.S. at the United Nations and other international forums.

Obama obviously has decided to act on his own because he faced little opposition from Congress when he overreached his authority and acted on his own by giving amnesty to 5 million illegal immigrants. Congress needs to act now, or Obama simply will move on to the many other items on his bucket list.

Congress must make it abundantly clear to Obama that he does not have the authority to lift the embargo on Cuba on his own. Doing so would break U.S. law, namely the Helms-Burton Act.

Senators also should make clear they will not allow the appointment of an ambassador to Cuba to proceed until there have been changes on the island and look into the possibility of using policy riders in the upcoming Department of Homeland Security appropriations debate in February and the fiscal year 2016 appropriations process to deny the president funds for setting up relations.


Congress should be doing a lot of things to stop O’s lawlessness, but they don’t do anything except jump in front of a TV camera and talk more gibberish. And Boehner’s House of Deceit will fund any and all of O’s dirty deals that get us nothing in return.

O left a Marine rotting in a Mexican jail for months without lifting a finger, he gave away the farm to free Bo Bergdahl, a deserter, and now he’s giving Castro back his spies. Again the US gets zip and the people of Cuba are no better off than they were last week.

Right now Castro is laughing so hard he can barely tie the bow on the box of cigars he’s sending O for Christmas.

    Exactly right, Kathy. This has me fuming. The pomp arrogance. Normalizing relations with Kooba when in reality there is nothing normal about Obama or Cuba.

      You said it, Bull – there’s nothing normal about either of them. What’s so aggravating is that he comes up with a new trick almost on a weekly basis now. He seems to be picking up speed with his royal edicts.

    Gentle beings,
    I am getting more and more afraid that there will be an uprising of some sort in this country.
    The president does not see himself as constrained by either law or custom.
    The Congress (both parties) appear to be more interested in gaining power than doing what’s right.
    The people are more and more divided.
    The people are more and more divisive.

    This scares me.

      True on all counts, VM, The uprising is already in the beginner stages and that is because our out-of-control regime is fueling the divisiveness, while our lay-down Congress does nothing but submit to his will. It scares me too.

    Damn, I sure would like to play a little stud poker with Omama. He’s stupid enough to show his hole cards and THEN bet. This half-breed fother-mucker is leading us to ruin and STILL nearly half of America would vote for him again if he were able to run. Are we doomed as a nation? I am starting to wonder. Too many stupid people who should not be voting are ruining America. Guess the party?

    If America wasn’t the international joke we’ve become under the Omama regime this Greek tragedy we’re living right now might actually be funny. But outside of the Theocrats in the Middle East and the Godless commie bastards in China, NoKo, Cuba, and what’s left of the old Soviet Union, no one else is laughing.

    God how I despise this petulant man/boy posing as our leader. The fact that he relies on the RevRearEnd Al Sharpton as an adviser and for guidance makes me want to puke. It’s so freaking twisted it’s almost comical.

    2016 can’t come soon enough. I pray America (if there’s anything left of her) will wise up to the lunacy of the democrats but I am just not sure anymore. There are just too many moochers and welfare leeches to overcome. And the dems rely on stupidity of the voters as “Angry White Dude” often says on his website. It used to be just words for a bumper sticker but now it’s fact.

    There are too many people in the country who are eligible to vote and want “something” for nothing. And I wish the pundits would quit calling these jerks LIV’s. They’re stupid, not low information voters. And they’re calling the shots because they breed like rats. The dems will promise and most likely give these parasites that “something” for nothing that they’re always demanding. The dems are selling out America’s future in the name of power and perks. Damn them all to hell. The second Revolutionary War may come sooner than most of us think because of the shit the democrat party is pulling on America. It’s getting close to the fail-safe point and things won’t be able to be turned back.

    I’m on a manic roll tonight and I can’t trash the democrat party enough to get it out of my system. Must have been something I ate I guess. it’s a good thing I don’t drink anymore or else the dems would get me started pulling corks. Come to think of it a shot of good Scotch over ice sure sounds nice. My head says yes but my ulcer says no. Besides, it’s too late here on the left-coast. Time for bed.

      A really good rant, Rich. I worry too about what’s going to be left of our country by 2016. If the new Senate doesn’t gain backbone and strength to make some changes, we might not.

      Ditto that, Hardnox. Every week it seems he come up with another trick he can pull off that sends us even farther down the drain. I don’t know where he comes up with these ideas, but Valerie Jarrett must be working 24/7. Who would have ever thought to change our relationship with Cuba, and especially with so little in return??

      Maybe we’ll get a break next week while he’s on his umpteenth vacation.

        I wish Kathy. But he just keeps coming back to D.C. after a couple of weeks. Maybe he’ll fly on Malaysian airlines instead of Air Force One. That’s the ticket!
