New documents obtained and released through a Judicial Watch lawsuit show the targeting of tea party and conservative groups came directly out of Washington D.C., not a rogue IRS office in Cincinnati.

On July 6, 2012, former Director of the IRS Rulings and Agreements Division and current Manager of Exempt Organizations Guidance Holly Paz sent an email to IRS Attorney Steven Grodnitzky asking for an explanation of how tea party group applications were being handled. Grodnitzky responded by confirming the cases were being handled in Washington.

“EOT is working the Tea party applications in coordination with Cincy [Cincinnati]. We are developing a few applications here in DC and providing copies of our development letters with the agent to use as examples in the development of their cases. Chip Hull [another lawyer in IRS headquarters] is working these cases in EOT and working with the agent in Cincy, so any communication should include him as well. Because the Tea party applications are the subject of an SCR [Sensitive Case Report], we cannot resolve any of the cases without coordinating with Rob,” Grodnitzky wrote.

When the IRS targeting scandal broke last year, officials in Washington immediately pinned the blame on the Cincinnati office. This documentation proves not only that direction was coming out of Washington, but that Washington instructed Cincinnati about how to handle tea party applications.

A new email from Lois Lerner also details how BOLO lists (be on the look out) were specifically created for tea party groups or groups with issues related to government spending, debt, taxes and “how the country is being run.”

“Because the BOLO only contained a brief reference to “Organizations involved with the Tea Party movement applying for exemption under 501(c)(3) and 501(c)(4)” in June 2011, the EO Determinations manager asked the manager of the screening group, John Shafer [IRS Cincinnati field office manager], what criteria were being used to label cases as “tea party ” cases. (“Do the applications specify/state ‘ tea party’? If not, how do we know applicant is involved with the tea party movement?”) The screening group manager asked his employees how they were applying the BOLO’s short –hand reference to “tea party.”

His employees responded that they were including organizations meeting any of the following criteria as falling within the BOLO’s reference to “tea party” organizations: “1. ‘Tea Party’, ‘Patriots’ or ‘9/12 Project’ is referenced in the case file. 2. Issues include government spending, government debt and taxes. 3. Educate the public through advocacy/legislative activities to make America a better place to live. 4. Statements in the case file that are critical of the how the country is being run. . . ” Lerner wrote on April 2, 2013. “So, we believe we have provided information that shows that no one in EO “developed” the criteria. Rather, staff used their own interpretations of the brief reference to “organizations involved with the Tea Party movement,” which was what was on the BOLO list.”

Judicial Watch also found the IRS put red and orange alert symbols on tea party issues for heightened awareness. Here are two slides from a “Heightened Awareness Presentation” used at the IRS.

Further, documents show the IRS responded to “intense” requests from Democrat Senator Carl Levin to come down on conservative tax exempt groups in an effort to get rid of them, specifically the groups working against his reelection campaign.

Emails released by Judicial Watch last month show former head of taxpayer groups Lois Lerner was in contact with the Department of Justice about the potential criminal prosecution of conservative groups. In her emails about DOJ, Lerner noted that putting one person from a conservative organization in jail would create and example and “shut the whole thing down.”

It’s just a guess, but I’m thinking this goes all the way to the top, starting with Valerie telling O what instructions to give Lois. After making statements like that, it’s no wonder Lois Lerner pled the Fifth, but it’s not just her butt she’s trying to save.

don't tell anyone

The question is what will Holder do now that JW has exposed her real intent and exposed that she was in contact with the DoJ.  Will he follow through with punishment or let her skate?

By handing off her fate to Holder, Boehner was either really shrewd and knew this was coming, or he’s a coward and running from his responsibilities. Is it possible he actually had a shrewd moment? Maybe…just a smidgen.

Not EVEN a smidgen, Kathy. The man is a total whimpering, sniveling coward, passing the buck, hoping Holder will hang himself in the process of the continual cover-up.
IF he were, indeed, “shrewd”, he’d have made this front page news – he’d have done interviews, on every available channel, stating as such. But to my knowledge, – crickets…
While Boehner’s actions are merely an attempt to maintain his relevancy, Hold-em-up is going to wind up either letting her pass or allow her to go through the judicial process and then step in, either exonerating her or fixing the trial from the start.
Nothing is beyond this crew – NOTHING!

I’m sure you’re right and I’m just holding on to a thread of hope that for once someone made a smart move. My brain knows better.

Boehner and his gang never really have a plan, instead they just react.

  2. Buck says:

And Senator Levin is knee deep in it all….

  3. propblast says:

Holder, former assistant AG. under bubba Clinton, wrote 11th hour pardons for bubba. So anything can happen here, except real justice!

Boehner, I think Janky has put it best. after all JB is running for office, again.

Carl Levin, “going to work for the people, and do what is best for them, in the time I have left,” No reelection campaign for him. The IRS issue would have come up, and he has not answered any questions about his involvement. Even the neo-cons at WJR (abc affiliate) have given this a wide pass. Going to miss Carl, like I miss having a tooth ache….
and Buck, he is knee deep alright, he went in head first.

    • Kathy says:

Levin will skate just like they all do. As you said, real justice never happens.

That’s what we get when you have one agency in charge of judging and punishing other agencies. Someone compared it to allowing students to grade their own tests. Everybody passes using that method.

  4. CW says:

Yep, no bias there! They’re just targeting Tea Party candidates, that’s all.

I don’t know that we’re ever going to find a smoking gun to the WH but IMO it doesn’t matter. This highly partisan WH fostered the atmosphere that took hold in the IRS and they’re hands are dirty just be virtue of their attempts to sweep this under the rug and, as always, hold no one accountable.

One last thing. >>”Lerner noted that putting one person from a conservative organization in jail would create and example and “shut the whole thing down.'”

I think we should put Lerner in jail so she could see how her theory works in practice.

    • Kathy says:

You’re right CW – we’ll never find that smoking gun to the WH because everyone keeps covering for him. If they don’t, or if they disagree, they get fired.

I’d love to see her in jail too, where she belongs.

If this is what they do pretty much out in the open, imagine what they do in the darkest corners?

  6. vonmesser says:

Bull – Kathy – That’s for darn sure.
